1. Agreement
These Terms of Service (“Terms”) govern your access to https://pharionxthorxian.world/ (the “Site”) and any purchase of Vascoralis or related products (collectively, “Products”). By using the Site or placing an order, you agree to these Terms and our Privacy Policy and Cookie Policy. If you do not agree, do not use the Site.
2. Eligibility
You must be at least eighteen years old and capable of forming a binding contract. If you use the Site on behalf of an organization, you represent that you have authority to bind that organization.
3. Product information
Descriptions, photographs, and graphics are for informational purposes. We make reasonable efforts to ensure accuracy; however, packaging, batch numbers, or minor formulation adjustments may change without notice when required by suppliers or regulators. Products are dietary supplements and are not intended to diagnose, treat, cure, or prevent any disease.
4. Orders and acceptance
An order request submitted through the Site constitutes an offer. We may accept or decline orders for any lawful reason, including product availability, suspected fraud, shipping restrictions, or pricing errors. You receive a contractual commitment only after we send an order confirmation or ship the Products, whichever we specify in our workflow.
5. Pricing and taxes
Prices are shown in U.S. dollars unless stated otherwise. Applicable sales, use, excise, or value-added taxes may be added at checkout based on the shipping address you provide. Promotional pricing may be time-limited; we will honor pricing errors only as required by law.
6. Payment
We accept payment methods displayed at checkout. You authorize us and our payment processors to charge your selected method for the total amount, including taxes and shipping. You represent that you are authorized to use the payment method. If payment fails, we may cancel the order.
7. Shipping and title
We ship to addresses within the United States unless we expressly state otherwise. Risk of loss passes to you when the carrier records delivery or makes the parcel available for pickup. Title passes upon full payment unless applicable law mandates an earlier or later moment.
8. Returns and refunds
Returns and refunds are governed by our Return Policy, which is incorporated into these Terms by reference.
9. Acceptable use
You agree not to misuse the Site, including by attempting unauthorized access, interfering with security features, scraping data in violation of these Terms, or using the Site for unlawful purposes. We may suspend access if we reasonably believe a violation occurred.
10. Intellectual property
All content on the Site—including text, graphics, logos, and layout—is owned by Pharionxthorxian or its licensors. You may not copy, modify, distribute, or create derivative works without prior written consent, except for temporary copies needed to browse the Site.
11. Disclaimers
To the fullest extent permitted by law, the Site and Products are provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow certain disclaimers; in those jurisdictions, our liability is limited to the minimum permitted.
12. Limitation of liability
To the maximum extent permitted by law, neither Pharionxthorxian nor its directors, employees, or suppliers will be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Site or Products. Our aggregate liability for any claim relating to an order will not exceed the amount you paid for that order. These limitations do not apply where prohibited by law.
13. Indemnity
You will defend and indemnify Pharionxthorxian against claims arising from your misuse of the Site, violation of these Terms, or infringement of third-party rights, except to the extent caused by our willful misconduct.
14. Governing law and disputes
These Terms are governed by the laws of the State of New York, excluding conflict-of-law rules. You agree that state and federal courts located in New York County, New York have exclusive jurisdiction, subject to mandatory consumer protections in your place of residence where applicable.
15. Electronic communications and records
You consent to receive notices, receipts, and contracts electronically. We may communicate through email, postings on the Site, or other reasonable electronic means. You are responsible for keeping your contact information current. Printed copies of electronic records are admissible in the same manner as other business records to the extent permitted by law.
16. Force majeure
We are not liable for delays or failures caused by events outside our reasonable control, including natural disasters, war, terrorism, labor disputes, utility failures, government actions, pandemics, or supply-chain disruptions. If such an event persists, we may suspend performance until conditions stabilize and will use reasonable efforts to notify you.
17. Third-party services and links
The Site may reference tools operated by payment processors, carriers, or analytics vendors. Their services are governed by their own terms. We are not responsible for third-party websites you access through links; review their policies before providing information.
18. Export and sanctions
You represent that you are not located in a country subject to comprehensive U.S. sanctions and that you are not listed on any U.S. government restricted-party list. You will not export or re-export Products in violation of applicable laws.
19. Severability and assignment
If any provision of these Terms is held invalid, the remaining provisions remain in effect. You may not assign your rights without our consent. We may assign our rights in connection with a merger, acquisition, or sale of assets, provided your contractual benefits are preserved where required by law.
20. Entire agreement
These Terms, together with the policies linked herein, constitute the entire agreement regarding the Site and supersede prior oral or written understandings on the same subject, except where fraud or mandatory law provides otherwise.
21. Changes
We may modify these Terms by posting an updated version on the Site. Material changes to orders in progress will be communicated when feasible. Continued use after the effective date constitutes acceptance unless applicable law requires express consent.
